Ex-Kisumu ICT director denies forgery charges, released on KSh 1 million bond

The former Kisumu County Director of Communications and Technology, Nick Odhiambo Migot, was arraigned before Chief Magistrate Dickson Onyango today, where he denied charges of forgery and fraud.

Migot was arrested on Tuesday, January 14, by the Ethics and Anti-Corruption Commission (EACC) for allegedly forging academic certificates to secure his position within the county government.

During the court proceedings, Migot’s lawyer, Nicholas Edris Omondi, appealed for bail, emphasizing his client’s constitutional rights and family responsibilities. After deliberation, Chief Magistrate Onyango granted Migot a bond of KSh 1 million with one surety.

“I consider the principles guiding the court on the issue of bail and bond, as highlighted by Mr. Edris Omondi, counsel for the accused. I am alive to the fact that the accused has constitutional rights to be presumed innocent until proven guilty, and his treatment at this stage should reflect those rights,” stated Chief Magistrate Onyango.

The magistrate acknowledged the gravity of the charges against Migot, noting they involve serious felonies carrying severe penalties.

“Having balanced his constitutional rights, the nature of the charges, and the need for proportionality, I have set the bond at KSh 1 million with one surety. I will also call for a pretrial report to determine whether it may be reasonable to release the accused on cash bail. In the meantime, the prosecution shall supply the defense with copies of witness statements and all documentary evidence they intend to rely on during the trial,” he added.

The case has been scheduled for mention on February 4, 2025, as the court prepares for trial.

The proceedings come amid increased efforts by the EACC to combat forgery and fraud within public service appointments. The commission has reiterated its commitment to holding individuals accountable for misrepresentation and dishonesty in public office.
