Former nominated Kisumu MCA Carren Atieno Muga is now a free woman after a Kapsabet court ruled that she has no case to answer in a suspected organ trafficking case linked to the murder of Enock Kipsang in Chemase, Nandi County.

Delivering the ruling on January 10, 2025, Chief Magistrate Kibet Sambu stated that there was no evidence implicating Atieno in the crime and ordered her immediate release.

“The miscellaneous application presented in the obtaining circumstances and there being no evidence gathered towards the respondent to the commission of murder which was under investigation, be and is hereby marked spent and closed, and the respondent consequently set at liberty to enjoy her freedom established under the Constitution (2010),” Sambu ruled.

The magistrate also declined to issue any orders regarding a motor vehicle detained at Kapsabet Police Station, citing a lack of correlation with the case. Additionally, he ruled that Atieno was no longer required to report to the DCI for further investigations, declaring the matter closed.

Following her exoneration, Atieno spoke to the press in Kisumu, demanding a public apology from the media for what she termed as misinformation that tarnished her reputation.

“It is true that when this happened, I did not know what caused it. If possible, according to the ruling, can you apologize for what you announced so that the world can know it was a lie? I am a leader, even in the church. What can you do to clear my name now that the court has found I have no case to answer?” Atieno questioned.

She further stated that she bore no resentment but needed time to recover from the ordeal. “I don’t feel threatened. I left that place with a lot of pressure, so I wanted to rest. I am 63 years old; I can still go to my home,” she added.

Former Kajulu Ward MCA Roy Samo

Former Kajulu Ward MCA Roy Samo also weighed in, attributing Atieno’s arrest to insecurity and tensions along the Kisumu-Nandi border. He urged the Ministry of Interior to intervene and resolve ongoing border conflicts.

“There has been a lot of insecurity in Sondu and Chemase, the border between the Luos and Kalenjins, where people are being killed daily. If the PS for Internal Security and the CS can come down and find a solution, it will help. Hon. Atieno was wrongly framed as one of the people behind the mayhem, and she was not part of it. The media ran the story differently, and that is why she wants the truth to be aired,” Samo stated.

Atieno’s daughter, Olgah Atieno Waguda, condemned the allegations, saying they had severely damaged her family’s reputation. She revealed that their tenants vacated their rental properties due to fears linked to the case.

“On behalf of my family, we were deeply affected. This was a defamation of character. We have lived in Miwani for over 20 years, and people know our character. When my mom was still an MCA, she bought land and built rentals, but look—our tenants left out of fear. She is a human rights defender who has sponsored students and helped many. Some people feel she shouldn’t be where she is because she is a strong woman standing for people’s rights,” she stated.

Atieno has now set her sights on clearing her name, urging the media to correct the narrative that linked her to the crime.
