Former Deputy President Rigathi Gachagua’s impeachment challenge resumes Thursday at the Milimani Law Courts’ Ceremonial Hall, in a case that could reshape the legal boundaries of removing senior state officers from office.

The hearing was earlier postponed to May 7th to allow Justice Antony Mrima to participate in Supreme Court judge interviews as part of the Judicial Service Commission panel. Gachagua was removed from office in late 2024 through an unprecedented parliamentary process, becoming the first deputy president in Kenya’s history to be impeached.

What the Case Hinges On

Gachagua’s legal team has challenged the constitutionality of the impeachment process, arguing that the Senate violated due process and that the charges against him were politically motivated. The former DP has maintained his innocence throughout, claiming the entire exercise was orchestrated to settle political scores.

The case raises fundamental questions about the balance of power between Parliament, the Senate, and the Judiciary. Legal experts say the court’s ruling could set a lasting precedent for future impeachment proceedings against senior government officials.

Political Stakes Remain High

The impeachment saga divided the country along political and regional lines, with Gachagua’s supporters in the Mount Kenya region viewing his removal as a betrayal. His replacement, Deputy President Kindiki Kithure, has since settled into the role, but the underlying political tensions have far from disappeared.

Political analysts say a favourable ruling for Gachagua could shake up the current administration’s political calculations ahead of the 2027 general election, even though reinstatement to the deputy president’s office appears unlikely.
