Gor Mahia patron Eliud Owalo has withdrawn both his application for conservatory orders and the memorandum of appeal he had filed at the Milimani High Court challenging a Sports Disputes Tribunal (SDT) decision that effectively ended his tenure as the club’s patron.
In a notice dated August 14, 2026, Owalo formally withdrew the entire Notice of Motion dated August 5, together with the accompanying Memorandum of Appeal filed on the same day.
The withdrawal comes after the High Court declined to grant the conservatory orders and other interim reliefs sought by Owalo in his bid to suspend the effect of the SDT judgment delivered on August 4.
The dispute stems from SDT Case No. E024 of 2026, in which the tribunal cancelled Owalo’s appointment as the patron of Gor Mahia.
Owalo had moved to the High Court seeking temporary injunctive and status quo orders pending the hearing and determination of his appeal against the tribunal’s decision.
However, following the court’s refusal to grant the interim orders, Owalo has now abandoned both the application and the substantive appeal.
The latest development leaves the SDT decision in force, meaning Owalo ceases to hold the position of Gor Mahia patron unless he is subsequently appointed through the club’s constitutional process.
The position could, however, remain difficult to fill in the prevailing circumstances, particularly in the absence of a functioning Board of Trustees (BOT), which is central to the club’s constitutional appointment process.
The legal battle pitted Owalo against Samuel Ochola, Ambrose Rachier, Sally Bolo, Nick Arum and Gerphas Okuku, who were parties in the proceedings before the SDT and the subsequent High Court matter.
The notice of withdrawal was filed in Nairobi on Friday, August 14, by Nchoe, Jaoko & Company Advocates, representing Owalo.
The withdrawal marks a significant turn in the increasingly contentious dispute over the leadership and governance of Gor Mahia, one of Kenya’s most prominent football clubs.
